And he may also make limited modified copies of the program. Of course, these copies will be for his own use only except as explained in the next paragraph. The purchaser of a copyrighted program may sell opyrighted by another person, etc. The 1980 amendment to the copyright law that specifically authorized copyright protection for computer programs also gave certain rights to purchasers of these programs. First of all the purchaser of a computer progn be copyrighted. Computer databases may also be copyrighted. However, contents of the database that are not eligible to be copyrighted will not be covered by the database's copyright. This could include information that is in the public domain, is c of original ideas, as distinguished from the ideas themselves." The statute defines a computer program as "a set of statements or instructions to be used in a computer to enable it to perform". A computer program that meets the above requirements ca facts, ideas, processes, systems and formulas can NOT be copyrighted. Computer programs and databases are considered to be (non-dramatic) literary works, and are therefore copyrightable, if they "incorporate authorship in the programmer's expressiontory provisions. In 1980, Congress amended section 117 of this Act thereby authorizing copyright protection for computer programs. First of all it is important to note that only material that is original with the author can be copyrighted. Historicalz|}~opyright your programs and databases? Of course, he can only sell it once and he must sell (or give or trade, etc.) the original and all of his copies to one person and at the same time. It is analogous to your selling any property you own. You of course can sell, or give away, or trade, anything you own. And this is true of a copyrighted computer program. You cannot increase its distribution or you will be infringing the copyright and may be liable for civind your registration fee (which for Class TX is ten dollars). I will tell you later how to get the application forms which are free. If your program is in machine-readable form you do not have to provide the copies for the Library of Congress but musny actual damages you can prove. How to register your copyright. It is very simple. You fill out a Class TX application form (Class TX is for non-dramatic literary works), send two copies for the Library of Congress and one for the copyright office as $50,000 rather than $10,000. In addition you will be awarded attorneys' fees from the losing party. But remember you will get neither of these valuable remedies if your copyright is not registered. You will, as I stated before, still be able to receive ae to prove ANY actual damages in order to recover a minimum of $250.00 up to $10,000. The two exceptions are that if it is an innocent infringement the minimum statutory damage is $100.00, instead of $250.00, and if it is willful infringement the maximum iages, if your copyright was registered. The statutory damages for copyright infringement are usually a minimum of $250.00 and a maximum of $10,000 as the Court feels is just. What this means is that if you win a copyright infringement suit you will not hav to your reputation, etc.). However, the law also provides for statutory damages and attorneys fees in infringement cases where there was a proper registration. Statutory damages are damages that you have the option of electing, in lieu of actual damement suit and if it later registered you will be denied certain remedies for infringement as explained below. If your copyright is infringed you will always be entitled to recover any actual damages that you can prove (such as loss of profit, damageI would also suggest that it be printed on the screen, or printer, each time the program is run. If this notice is placed on your program or database it is copyrighted. However, if your copyright is not registered you cannot bring a copyright infringit will be reasonably expected to give notice of the copyright claim. Since there are separate charges for the disks, when you order, just get the system you need. You must choose the one you wish, and go from there. For my purpoed on the drive itself, the disk controller. SOFTWARE COMPATIBILITY The package came with three disks. One each to configure for CP/M, Apple DOS, or PASCAL. This drive does not allow you to partition its surface into athe parts go into that unit. The last step is to put the disk controller into the Apple. Goes in like any other disk controller. I put it into slot 5. XEBEC calls their controller a "Personality Interface Card". They call the large card you mounte from the power supply to the hard drive itself. There was only one possible way for it to attach so there was no problem. That all there is too it. XEBEC did not send me their external cabinet, so I cannot talk about what it looks like or how sheets. But, as I said, I read and re-read the instructions, decided that the stripes being parallel was what the drawings showed, and went ahead and plugged the cables in to both sides of the drive. Next, I attached two cords and a ground wirowever, striped on one side. I just followed the picture and kept the stripes parallel rather than twisted and things went ok. It would have been better to have received an actual picture of a completed assembly rather than copied instructiondrive. You then connect two cables to the drive. Connecting the cables was the hardest part of the assembly. The assembly instructions said to go from pin 1 to pin 1. However, my cables were not labeled, and neither were the pins. They were, h The only equipment you need is a Phillips screwdriver. The procedure is to unpack everything. After screwing on a small platform to each side of the hard drive, you mount a XEBEC S1410 disk controller ( a card ) onto four posts connected to the hard ngs to do to put the package together. It took about 30 minutes. Most of that time was spent reading the assembly and installation manual. If I had just looked at the pictures and started there, I would have been up and running in about 10 minutes. ,200 (approximate) One day a large box arrived. In it, was a number of smaller packages. Instructions said that when these multitude of parts go together, I would have a 5 mega-byte(mb) hard drive. Actually, there were only about 8 separate thi XEBEC HARD DISK KIT Review (c) copyright by Woody Liswood 1982 Manufactured by: XEBEC AN MSC COMPANY Box 512 432 Lakeside Drive Sunnyvale, CA 94086 (408) 735 - 1340 Price: $1ses, a CP/M hard drive made the most sense because of the extensive use I make of WordStar and other related CP/M products. As you know, (in CP/M) much of what you need to do requires that you have the program and the working file(s) on the same disk drive. I was using a three drive system and still ran into problems making enough work space to handle a program, a working disk, a dictionary, and other goodies. Now, I have all those files on a drive which still leaves me with 3,000K valent of 35 tracts of 256-byte sectors. To make hard-disk space available to the user the 3 tracks of system area (normally found at the front of real Apple 16 sector floppies) has been made directly available as file space to the user. The 4quivalents at the front of the hard disk. Any remaining space on the hard-disk is allocated, as far as it will go, into virtual floppy disks that are each 4 times the size of the nominal-floppy image. Note that the nominal-floppies are the equir, the XEBEC will not take copy-protected programs. When you use DOS, you must be using a program which will allow you to specify all three locations, not just slot and drive. The XEBEC documentation says: "There can be 1 to 34 nominal- floppy ek. Then, if you wish to boot with the XEBEC, you must create the Boot track. All of these things are menu controlled. From now on, you must remember to specify volume as well as slot and drive when you wish to get to your information. Remembe formatting and configuration schemes. You should read that part before you start the formatting process and choose the one best suited to your individual needs. After you have formatted the XEBEC, you must patch DOS to recognize the Hard Disis one other decision to make. That is how many disks to you want to appear on the hard drive. XEBEC recommends 10, but the choice is up to you. The documentation contains a rather lengthy discussion about the pro's and con's of variousn CP/M the controller must go into 5. With DOS, you have a choice. XEBEC points out that if you have the hard drive in a slot with a higher number than the floppy controller, then the XEBEC will boot upon power-up rather than the floppy. There hat brings you to a menu which will allow you to format the hard drive, patch dos, create boot tracks, initialize volumes, reset slot and drive numbers or quit altogether. When you format the hard drive, you must specify the slot for the controller. Iou have a hard disk, you will have to start to keep track of volumes. That's how DOS knows where to go when it looks at those "phantom" disks that will appear to exist on the XEBEC. Anyway, after you catalog the disk, you BRUN INIT DISK. T DOS If you are going to use with DOS, you can run 4 drives. There are extensive instructions for formatting with DOS. What happens is that you boot your system master. Then insert the XEBEC DOS disk. Catalog, S6,D1,V1. Now that yo drives. One at about 4 mb and the other about 1 mb. Now, in effect, I have a system which has drives A and B as normal Apple II floppies. Drives C and D are on the hard disk, C is 4,000 K Long and D is 1000 K long. Works great. format utility that you have. About 9 minutes later you will have a 5 mb CPM disk drive. During the configuration process, you are given some options as to how many drives you wished the XEBEC to appear. You can have up to 4 drives. I choose twthout paying any attention to the physical system. The CP/M system is designed to only support two floppy drives in addition to the XEBEC. The formatting goes rather simply. Copy the XEBEC programs to a working copy of your CP/M system. Run the XEBEC of space. And I am able to do development work with dBASE on the other drive with 1,000K of space. Wow, all of a sudden all of my complaints about disk swapping and logged drives with soft-boots of the CP/M system are gone and I can mostly work wiK virtual floppies also are entirely available for user files. A side effect is that one cannot boot from any of the virtual floppies. The real hard disk boot-block and system area preponds all of the virtual floppy areas. Note, therefore, that each and every virtual floppy on he XEBEC Hard Disk may hold more data than can be backed up on a single real 16-sector floppy." Did you get all that? PASCAL I have no PASCAL applications, so I did not test that parts about to release a interface for the Apple ///. From a critical viewpoint, It would make more sense to be able to run CP/M, DOS, and PASCAL all from the same disk. But that is my only criticism. see how I lived without it. For business applications, I don't think I will ever recommend that a client just go with floppies. At this price, and for this convenience, I personally feel that everyone should have one. Rumor also has it that XEBEC i1800 to $2000. If you don't mind having to use a screwdriver for about 8 screws and hook up some cables, then why spend that extra money. I really don't know why I did not have a hard drive all along. Now that I have been using one, I really don't tes at 3600 rpm, there is not much to say. Having all that space makes things much easier. I backup files by copying from the hard drive to the floppies as needed.
